LIABILITY WAIVER & ASSUMPTION OF RISK AGREEMENT

By purchasing, receiving, or using any product from this website (“Products”), you (“Buyer”) agree to the following legally binding terms. If you do not agree, do not purchase or use our Products.

1. Research Use Only

Buyer acknowledges and agrees that all Products are:

  • Strictly for laboratory, scientific, or in-vitro research
  • Not for human consumption
  • Not for medical, therapeutic, or diagnostic use
  • Not for veterinary or injectable use
  • Not drugs, supplements, or cosmetics

Buyer understands that misuse of research chemicals may pose significant hazards.

2. Assumption of Risk

Buyer acknowledges that handling research chemicals involves risks, including but not limited to:

  • Chemical exposure
  • Allergic reactions
  • Toxicity
  • Contamination
  • Biological hazard
  • Storage instability
  • Unknown reactions or degradation

Buyer voluntarily assumes all risks, both known and unknown, associated with handling, storing, transporting, or using the Products.

3. Buyer Certification

By purchasing Products, Buyer certifies that they are:

  • At least 18 years of age
  • A researcher, laboratory user, institution, or qualified individual capable of safely handling research chemicals
  • Fully aware of the potential hazards
  • Purchasing for lawful research purposes only
  • Not using Products for human administration of any kind
  • In compliance with all federal, provincial, and local laws

Buyer assumes full responsibility for ensuring Products are used lawfully and safely.

4. No Liability for Misuse

Buyer agrees that the Company is not liable for any damages, injuries, losses, or consequences resulting from:

  • Misuse, mishandling, or unsafe practices
  • Application to humans or animals
  • Injection, ingestion, inhalation, or dermal exposure
  • Failure to follow safety protocols
  • Failure to store Products properly
  • Experimental failure or unexpected reactions
  • Any use outside of intended research scope

This includes direct, indirect, incidental, or consequential damages.

5. Indemnification

Buyer agrees to fully indemnify, defend, and hold harmless the Company from any claims, liabilities, losses, costs, damages, or legal fees arising from:

  • Buyer’s use or misuse of Products
  • Buyer’s violation of this waiver
  • Buyer’s breach of laws or regulations
  • Claims from third parties relating to Buyer’s actions

This indemnification survives the termination of this Agreement.

6. No Warranties or Guarantees

Products are sold “as-is” with no warranties, including but not limited to:

  • Safety
  • Purity
  • Efficacy
  • Stability
  • Performance
  • Fitness for any particular purpose

Any descriptions, scientific references, or literature summaries on the Site are not guarantees of function or suitability.

7. Storage & Handling Responsibility

Buyer accepts full responsibility for:

  • Safe handling
  • Proper storage conditions
  • Shelf life awareness
  • Appropriate disposal procedures
  • Maintaining safe laboratory practices

The Company is not responsible for degradation, contamination, or instability due to improper storage.

8. No Medical Advice

The Company does not provide:

  • Medical advice
  • Treatment recommendations
  • Dosage instructions
  • Injection guidance
  • Human-use suggestions

Any informational content is for educational/literature reference only.

9. Release of Liability

Buyer hereby releases the Company from:

  • Any claims related to injury
  • Any damages arising from the use of Products
  • Any claims related to human use
  • Any liability for experimental outcomes
  • Any claims arising from third-party misuse

This release applies to all past, present, and future claims.

10. Governing Law

This Agreement is governed by the laws of the Province of Ontario and the federal laws of Canada.

Any disputes shall be resolved in courts located within that province.

11. Acceptance

By purchasing or using Products from this Site, Buyer acknowledges that they have:

  • Read this Liability Waiver in full
  • Understood all risks
  • Agreed voluntarily and knowingly
  • Accepted full responsibility for safe and lawful use

This Waiver remains in effect for all current and future purchases.
